The lawsuit (case number 1:2018cv22386), filed June 14, 2018 with the U.S. District Court for the Southern District of Florida, alleges MSC Cruises, S.A. violated the International Safety Management Code by failing to protect its passengers from sexual assault and battery.
According to court documents, the 14-year-old victim was allegedly attacked by an MSC Cruises, S.A. employee while aboard the MSC Divina during an eight-day cruise that left Miami on March 4, 2017 and returned to Miami on March 11, 2017. Ports of call were San Juan (Puerto Rico), Grand Turk Island (Turks and Caicos) and Nassau (Bahamas).
The lawsuit alleges the girl was a victim of sexual assault and battery on March 10, 2017 while visiting the cruise ship's candy shop. The alleged attacker was an MSC Divina crew member who was able to use the girl's cruise ID card to find out what had happened to her brother and that her parents had left the ship.
The trial is scheduled for July 15, 2019 in the U.S. District Court for the Southern District of Florida.
